1. Acceptance of Terms

By creating an account or using Glasshouse Memories, you agree to:

• These Terms of Service
• Our Privacy Policy

If you don't agree to these terms, you may not use Glasshouse Memories.

2. Eligibility

To use Glasshouse Memories, you must:

• Be at least 13 years old
• Have the legal capacity to enter into this agreement
• Provide accurate and truthful information when registering

If you are between 13 and 18, you represent that your parent or guardian has reviewed and agrees to these Terms.

3. Your Account

Account Security:

• You are responsible for keeping your login credentials secure
• You must not share your account with others
• You are responsible for all activity that occurs under your account
• Notify us immediately if you suspect unauthorized access

Account Information:

• You must provide accurate information when registering
• You must keep your information up to date

4. The Service

Glasshouse Memories allows you to:

• Create virtual "memory jars" to store written memories
• Jars automatically unlock on January 1st of the following year
• Invite collaborators to contribute memories to your jars

The unlock date is fixed at January 1st of the year following jar creation and cannot be changed by users.

We reserve the right to modify, suspend, or discontinue any part of the service at any time.

5. Your Content

Ownership:

You retain ownership of the memories and content you create. We do not claim any ownership of your content.

License to Us:

By posting content, you grant us a limited license to store and display your content as necessary to provide the service. This license ends when you delete your content or account (after the 30-day deletion processing period).

Your Responsibility:

• You are solely responsible for the content you create
• You are responsible for any consequences of your content
• Content that is embarrassing, regrettable, or sensitive is your responsibility
• We are not liable for memories you write and later regret

Prohibited Content:

You agree NOT to post content that:

• Is illegal or promotes illegal activities
• Contains threats, harassment, bullying, or hate speech
• Is defamatory or invades someone's privacy
• Infringes on intellectual property rights (copyright, trademark)
• Contains viruses, malware, or malicious code
• Is spam or unauthorized advertising
• Impersonates another person
• Exploits or harms minors in any way

Our Rights:

• We may remove content that violates these terms without notice
• We may suspend or terminate accounts for violations
• We are not obligated to review or monitor all content
• We are not responsible for content posted by users

6. Acceptable Use

You agree NOT to:

• Use the service for any illegal purpose
• Attempt to access other users' accounts or data
• Interfere with or disrupt the service
• Attempt to reverse engineer or hack the service
• Use automated tools to access the service without permission
• Violate any applicable laws or regulations

7. Intellectual Property

• The Glasshouse Memories name, logo, and design are our property
• The service, code, and features are protected by copyright
• You may not copy, modify, or create derivative works of our service
• All trademarks are property of their respective owners

8. Disclaimer of Warranties

We do not guarantee that:

• The service will meet your specific requirements
• The service will be available at all times
• Your content will be preserved forever
• Data will never be lost or corrupted

9. Limitation of Liability

EXCEPTIONS: These limitations do not apply where prohibited by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Glasshouse Memories and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your content
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any laws

11. Account Deletion

By You:

• You may delete your account at any time using the delete button in account settings
• Deletion is immediate and permanent - you cannot recover your account
• All your data will be permanently deleted within 30 days
• This includes all memories, jars, and account information

By Us:

• We may suspend or terminate your account for violating these Terms
• We may terminate inactive accounts with reasonable notice
• We may discontinue the service entirely with reasonable notice

After Deletion:

• You will lose access to all your content
• Deleted content cannot be recovered
• These Terms continue to apply for any disputes arising from your prior use

12. Dispute Resolution

Governing Law:

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Informal Resolution:

Before filing any legal claim, you agree to contact us at team.glasshousememories@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration:

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising from these Terms or your use of the service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules.

• Arbitration will be conducted in California
• The arbitrator's decision is final and binding
• Judgment may be entered in any court of competent jurisdiction

Exceptions: Either party may bring claims in small claims court if eligible.

13. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Glasshouse Memories.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

14. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the app at least 30 days before they take effect.

Your continued use of Glasshouse Memories after changes become effective constitutes acceptance of the new Terms. If you don't agree to the changes, you must stop using the service and delete your account.
